TERMS & CONDITIONS OF THE ON-LINE SHOP [www.herbio.co.uk]
I. General
1.1. The following terms and conditions apply to all orders placed by the client (hereinafter referred to as “you” or “the Client”) with Selpol Ltd hereinafter referred to as “on-line shop” or “we”, at www.herbio.co.uk (also referred to as the website).
1.2. The on-line shop available at www.herbio.co.uk is run by Selpol Ltd.
1.3. These Terms & Conditions shall specify in particular:
a.) the terms & conditions of registering on our website and using the account;
b.) the terms & conditions of making electronic reservations of products available at the on-line shop;
c.) the terms & conditions of placing orders by email;
d.) the terms & conditions of concluding contracts on services provided by the on-line shop.
II. Terms & Conditions of using the on-line shop
2.1. You have to accept the Terms & Conditions of the on-line shop prior to shopping.
2.2. The on-line shop may deprive the Client the right to use the on-line shop, as well as limit the access to part or whole of the products of the on-line shop with immediate effect, should the Client breach the Terms & Conditions, in particular should the Client:
a.) submit personal details which are false, outdated, unspecific, misleading or infringing the rights of the third parties during registration at the on-line shop,
b.) infringe the personal rights of third parties through the on-line shop, in particular personal rights of other clients of the on-line shop,
c.) commit other behaviours which in the opinion of the on-line shop are against the applicable provisions of the law or general rules of using the Internet or harm the interests of the on-line shop or the company Selpol Ltd
2.3. A person deprived of the right to use the on-line shop, may not re-register without prior consent of the on-line shop.
2.4. In order to provide security of transmission of messages and data in relation to the services provided within the framework of the website, the on-line shop undertakes technical and organisational measures appropriate to the degree of security risk of the provided services, in particular the measures to prevent acquisition and modification of personal details transmitted over the Internet by unauthorized persons.
2.5. The Client shall, in particular:
a.) not produce and transfer content prohibited by the law provisions, e.g. violent content, slandering or infringing personal rights and other rights of third parties,
b.) use the on-line shop without disturbing its functioning, in particular through the use of particular software or equipment,
c.) not undertake actions, such as: sending or posting unsolicited commercial communication within the framework of the on-line shop (spam),
d.) use the on-line shop without major inconvenience to other clients and to the on-line shop,
e.) use all contents of the on-line shop only for personal use,
f.) use the on-line shop in accordance with the provisions of the law and the provisions of these terms & conditions and general rules of using the Internet.
III. The procedure of concluding the contract
3.1. In order to conclude the contract via the on-line shop, go to the website www.herbio.co.uk, choose products you want to purchase, taking technical steps based on messages displayed to you and information available on the website.
3.2. Selection of goods ordered by you is made by adding them to your basket.
3.3. When submitting order – until you press the „Place Order”, you have the option to modify the implemented data and the chosen products. You should follow the displayed messages and information available on the site.
3.4. After you submit all necessary details, a summary of your Order will be displayed to you. The summary of the order will contain information on:
a.) the subject of the order,
b.) unit prices and total price of the ordered goods or services, including delivery costs and any additional costs (if applicable),
c.) selected method of payment,
d.) selected method of delivery,
e.) delivery time.
3.5. To send the order, it is necessary to accept the contents of the terms & conditions, submit your personal details marked as obligatory and press the button „Place Order”.
3.6. Sending the order by the Client constitutes a declaration of will to conclude the contract with Selpol Ltd in accordance with the contents of the terms & conditions.
3.7. After submitting the order, you will receive an e-mail with final confirmation of all material elements of the order.
3.8. The contract is deemed concluded at the moment of receiving the above e-mail by the Client.
3.9. The contract is concluded in English and is in compliance with these terms & conditions.
IV. Delivery
4.1. Delivery of your order takes place to the address indicated by the Client during placing the order.
4.2. Your order is delivered by Royal Mail or Parcel Force courier. The delivery costs are indicated during placing the order.
4.3. Time of delivery is from 1 to 3 business days following the date of placing the order.
4.4. We kindly request you to report undelivered orders after 2-4 business days following the date of sending the parcel, depending on the selected form of delivery.
4.5. Clients may get access to these terms & conditions at any time through the link on the home page of www.herbio.co.uk and download and print it.
Consolidation, security, access and confirmation of all material provisions of the contract to the Client shall occur through sending an e-mail and through attaching a print-out of the confirmation of the order specification to the parcel.
V. Prices and payments
5.1. Prices of products are provided in British Pound Sterling and include all components, including VAT, customs and any other components.
5.2. The Client may pay by:
a.) debit or credit card serviced by Nochex or Pay Pal,
b.) PayPal payment system.
VI. A right to withdraw from the contract
6.1. The Client has the right to withdraw from a distance contract without any reasons, submitting a written statement within 14 days and sending it to the shop address info@herbio.co.uk.
6.2. The 14-day period commences on the date of delivery of the products.
6.3. The right to withdraw from the contract by the Client is excluded in the event of
- the products exceeding the standard offer of the on-line prepared to the special order of the Client and adjusted to the Client’s individual needs;
- in which the subject of the provision is the thing delivered in a sealed package, which after opening the package can not be returned due to health protection or hygiene reasons, if it were unsealed after delivery.
6.4. In the event of withdrawing from the distance contract, the contract is deemed null and void. The subject of the provision is subject to be returned unchanged, unless the change was necessary in the ordinary course of business. The return should occur forthwith no later than within 10 days. The purchased products should be returned to the following address:

6.5. Goods returned by the Client should be packed in an appropriate manner ensuring no damages to the package during transport.
6.6. The cost of packaging and delivery shall be incurred by the Client .
VII. Complaints referring to the goods
7.1. Selpol Ltd as a seller is liable to the Client for incompliance of the goods purchased by the Client with the contract.
7.2. The complaints resulting from the breach of the rights of the Client, guaranteed by the law or pursuant to these terms & conditions should be addressed to info@herbio.co.uk. The on-line shop undertakes to consider each complaint within 14 days or in the event it is impossible, to inform the Client when it will be dealt with.
VIII. Complaints within the scope of provision of electronic services
8.1. Selpol Ltd undertakes actions to ensure proper operation of the on-line shop, within the scope which results from the current technical knowledge and undertakes to remove all irregularities reported by the Clients within reasonable time.
8.2. The Client is obliged to inform the on-line shop forthwith on any irregularities or interruptions in the operation of the on-line shop.
8.3. Irregularities related to the operation of the on-line shop may be reported in writing by the Client to the address: sklep@m-shop.eu or using our contact form.
8.4. The complaint should include the Client’s name and surname, correspondence address, type and date of the irregularity related to the on-line shop operation.
8.5. The on-line shop undertakes to consider each complaint within 14 days or in the event it is impossible, to inform the Client when it will be dealt with.
IX. Final provisions
9.1. The provisions of the consumer’s law, such as Distance Selling Regulations (DSR) 2000, Consumer Protection (Distance Selling) Directive 97/7/EC, Electronic Commerce Directive 2000 shall apply in matters not regulated by this Rules, Consumer Rights Act 2015.
